Conrad’s Law Is Dangerous Legislation That Infringes On The First Amendment And Will Be Exploited By Ratchets

 

I just wanna take a moment to mention how dangerous this new law is that the Massachusetts State Legislature is trying to pass.

This morning at the Statehouse in Boston, members of the late Conrad Roy’s family joined Senator Barry Finegold (D –Andover) and Representative Natalie Higgins (D – Leominster) to announce the filing of “Conrad’s Law,” a bill that would criminalize suicide coercion in Massachusetts. The narrowly tailored piece of legislation calls for a maximum five-year prison term for anyone convicted of the crime. The lead co-sponsor in the Senate is Sen. Mark Montigny (D-New Bedford)

Under the proposed law, a defendant can be convicted of suicide coercion if the defendant knows of another person’s propensity for suicidal ideation and either:

(1) (i) Exercise substantial control over the other person through control of the other person’s physical location or circumstances; deceptive or fraudulent manipulation of the other person’s fears, affections, or sympathies; or undue influence whereby the will of 1 person is substituted for the wishes of another;

(ii) intentionally coerces or encourages that person to commit or attempt to commit suicide; and

(iii) as a result of the coercion or encouragement, in whole or in part, that other person commits or attempts to commit suicide;

Michelle Carter is obviously a twisted woman who did a twisted, heartless thing when she repeatedly coerced Conrad Roy to get back into his truck in order to kill himself. But I was against her guilty verdict then because no one can make another person kill themselves unless that person is mentally handicapped and you convince them to run into traffic or hug a bear.

Ever since that verdict last August for manslaughter the number of people we’ve blogged about who have threatened to kill themselves in order to get revenge against me have increased dramatically. This new proposed law enables these people to do that, it incentivizes suicide attempts (as revenge), and it criminalizes speech.

It’s also vaguely worded and opens the door for the prosecution of anyone who said anything negative to someone who is suicidal. Look at the wording here:

(1) (i) Exercise substantial control over the other person through control of the other person’s physical location or circumstances; deceptive or fraudulent manipulation of the other person’s fears, affections, or sympathies; or undue influence whereby the will of 1 person is substituted for the wishes of another;

Define “substantial control over the other person’s physical location or circumstances.”

Let’s say some ratchet loses their section 8 housing voucher after we expose them selling food stamps on Facebook and they’re now homeless. You could argue that Turtleboy had control over that ratchet’s location and circumstance.

Define “undue influence whereby the will of 1 person is substituted for the wishes of another.”

Can you not see some ratchet make the case that they weren’t suicidal until Turtleboy came along and blogged about them? What about people who jokingly write, “kill yourself” in the comments? Are they going to jail too?

Under this law you don’t even have to kill yourself either in order to get revenge against someone. All they have to do is “attempt” to commit suicide. Define attempt. Does it count if they stand on top of a 6 story garage and threaten to jump? What it they take a bunch of pills and go to the hospital? Jeffrey Epstein appears to have faked his own suicide attempt in prison yesterday. Are people who have posted that he should kill himself going to be charged? After all, they knew he was suicidal.

When we blogged about Leigha Genduso last year she was put on suicide watch. I knew she was, but yet I continued to publish blogs about her when new information came forward. In her book she said that she went so far as to have a gun in her bedroom, ready to pull the trigger when police arrived at her house. Under this new law I could be charged with a crime, since I knew she was suicidal, she lost her job because the blog exposed her past, and according to her she attempted to commit suicide but couldn’t pull the trigger.

This law would open the door to all of this. There are no shortage of vicious lawyers out there who would use it to go after people not only in criminal court, but in civil court where the burden of proof is much lower.

The last thing we should be doing is giving the government more power to restrict our speech. There are already laws in Massachusetts against assisted suicide. We don’t need any more.
