Canton Coverup Part 478: Commonwealth Dog Bite “Expert” Gets Destroyed By Dr. Marie Russell In After David

Adam Lally and Hank Brennan have both tried to prevent Dr. Marie Russell, who has over 30 years of medical experience, from testifying that John O’Keefe was bitten by a dog. Both attempts failed because Judge Cannone couldn’t prevent someone as qualified and as experienced as her from testifying. Now the Commonwealth is trying to use a non-medical doctor named Jim Crosby to opine that Chloe never bit John O’Keefe, and Karen Read’s defense team is using their own arguments against them.

This is Jim Crosby:

He’s a YouTube dog guy who specializes in dog behavior. He’s done several interviews on small channels in which he talks mainly about why dogs attack people, which he seems to know a lot about. But he doesn’t know much about analyzing wounds to determine if they came from a dog, which is what the Commonwealth wants him to testify about.

In Karen Read’s motion to exclude Crosby’s testimony the defense points out that it is indisputable that Crosby is not a medical doctor.

During the June 18, 2024 voir dire of Dr. Andrew Rentschler, Judge Cannone made it clear that he could not testify on the medical causation of John O’Keefe’s injuries because only a medical doctor could do that.

Now the Commonwealth seeks to put forth an expert witness who is not a medical doctor to testify on the medical causation of John O’Keefe’s injuries. There is no way Auntie Bev can allow him to testify without coming across as overtly corrupt.

In his report Crosby tries to create a strawman argument that he should be allowed to testify because ‘this case is not about the treatment” of O’Keefe’s wounds.

But no one said that it was. The two people who testified that John O’Keefe was bitten by a dog are both medical doctors (Frank Sheridan and Marie Russell), and neither testified about treatment.

In his “report” Crosby opined that John O’Keefe’s injuries could not come from Chloe or any large dog – something that he has no qualifications to opine about.

The motion also eviscerates the idea that waiting 3 years to get a molding of what they claim is Chloe’s teeth (the defense was not allowed to see the dog they claim is Chloe) is something that can be used as evidence in court.

During Dr. Marie Russell’s cross examination at Read’s first trial she was asked about a 2009 report (that he erroneously said was a 2008 report) that said that examination of bite marks is not reliable evidence.

Indeed, he was correct that the report stated that. But now the Commonwealth is intending to use Jim Crosby as a witness to use the examination of what they claim are Chloe’s bite marks as a reliable science.

Additionally, the report from Crosby does not contain a single footnote. He just puts a long list of his “sources” at the end of the report, but doesn’t cite which ones he used anywhere in the report itself.

Dr. Marie Russell has been through a lot. She’s been smeared, challenged, and belittled by people much dumber than her, in Adam Lally and Hank Brennan. She’s got decades of experience and is widely respected in her field, yet was treated like some quack by the Commonwealth. Unfortunately for the prosecution this pushback has only strengthened her resolve, and now it’s Dr. Russell who is using their own arguments against them. In an after David she absolutely shredded Jim Crosby by pointing out his complete lack of communications and flawed methodology.

Considering Spanky Brennan’s obsession with saying the word “methodology,” it’s gotta sting him to the core to have it pointed out that his new star witness used flawed methodology.

“I am one such medical doctor.”

Owned.

Dr. Russell, in what I hope and assume is a shot at Brennan, goes into great detail about all the flaws in Jim Crosby’s methodology. For one, he assumed in his report that John O’Keefe’s arm was not moving, something that couldn’t possibly be true if he were bit by a dog.

He also inserted directional arrows on the autopsy photos which indicate that he didn’t know the direction the wounds were inflicted.

The McAlberts love to say that they can’t be bite marks because there are no marks for the bottom jaw. Jim Crosby also toko this position, which was flawed methodology because he wrongly assumed that both jaws of the dog would make compressions, as opposed to glancing bites against the skin.

Finally, Jim Crosby also noted in his report the other thing that the McAlbert Mafia clings to – the alleged lack of dog DNA on John O’Keefe’s clothing. But as Real Doctor Marie Russell pointed out, his methodology was once again flawed because the Commonwealth never swabbed John’s arm, and didn’t document collection of the evidence they swabbed (his sweatshirt).

Simply put, there is no way Auntie Bev can let Jim Crosby testify unless she overrules her previous ruling. As long as medical doctors are the only witnesses who can testify about the causation of John O’Keefe’s wounds, the Commonwealth will be unable to find ANYONE willing to testify that the bite marks aren’t from a dog. The defense just beat the Commonwealth at their own game.
