Canton Coverup Part 532: Turtleboy Defense Files Motion To Recuse Robert Cosgrove From McAlbert Indictments 

The Turtleboy Legal Defense Team has filed a motion today asking Special Prosecutor Robert Cosgrove to recuse himself from the 2023 indictments against me, which would leave the case stateless, and could lead to the charges being dropped:

Lindsey Gaetani’s lawsuit against Robert Cosgrove and Brian Tully, along with her threat to sue Michael Morrissey if he doesn’t pay her $50K, has created an irreconcilable conflict with:

1. Cosgrove (would have to discredit his own witness)
2. Michael Morrissey (can’t appoint a new prosecutor because they are a future defendant)
3. The Commonwealth

Robert Cosgrove cannot prosecute any matter in which LG is a witness or her credibility is an issue. He has already recused himself from the 2024 indictments stemming from the made up claims of witness intimidation on Christmas Eve at Lindsey Gaetani’s former Medfield residence, prior to her eviction. This leaves just the 2023 witness intimidation indictments involving Julie Nagel, Jen McCabe, Matt McCabe, Brian Albert, Chris Albert, and Colin Albert, and the 2025 indictments for doing T-Rex arms in front of a window.

However, Cosgrove also must recuse himself from the 2023 indictments for many reasons, because LG is undeniably a witness in that case:

• While the 2023 grand jury was taking place, Lindsey began communicating with Kate Peter and Leigha Genduso, and was brainstorming ways to make her a witness, in order to have me charged with witness intimidation against her
• Jennifer McCabe told Lindsey Gaetani on December 12, 2023 that “if you’re really sorry (for supporting Turtleboy) you will testify against him at the grand jury”
• Lindsey texted Kate Peter and told her that she was worried that she would charged with witness intimidation because she created a fake persona on Twitter called “Jane” that relentlessly attacked me under the cover of anonymity, while publicly supporting me while I was a witness
• Lindsey was interviewed by Brian Tully about information she had involving my relationship with Karen Read, as part of their ongoing investigation into the 2023 indictments
• On December 15 Lindsey posted to Facebook, “big news coming soon! Stay tuned.” The next day she taunted me by texting me “GJ” because she had discussed testifying against me at the grand jury with Tully. Her “big news” was that she was going to be a witness against me in the 2023 case.
• On December 22 Lindsey was served by Brian Tully with a grand jury summons which said at the top of it that they were investigating Canton witness intimidation in the 2023 indictments
• On December 28 Ken Mello told Jessica Machado in an interview that Lindsey Gaetani had “recently become a witness” against Turtleboy in the 2023 case
• In the affidavit written by Brian Tully to obtain Karen Read’s phone in December 2023, he cited a “witness” in my 2023 case, called “Jane.” He was referring to Lindsey, and once again calling her a witness.
• Lindsey’s 2024 grand jury testimony is all relevant and material to the 2023 indictments.
• Brian Tully subpoenaed my bank records and car information from Lexus, based entirely on what his “witness” Lindsey Gaetani told him in her December 14 interview
• Lindsey is also a potential witness for the defense, since she is making accusations against Jennifer McCabe, Robert Cosgrove, Ken Mello, Brian Tully, Kate Peter, and others involved in the 2023 indictments against me
• Lindsey has confirmed that messages from Kate Peter to her after December 14 were scrubbed by Brian Tully
